TWO NEW LAWS DEALING WITH THE USE OF CELL PHONES
WHILE DRIVING IN CALIFORNIA
For drivers 18 and older (Vehicle Code 23123):
- This law is considered a primary offense, and you can be pulled over for using a cell phone.
- It is legal to use a Blue Tooth headset or other hands-free device, but you cannot have both ears covered.
- It is legal to use the speaker phone function of your cell phone while driving
- It is not legal to use the "push-to-talk" function of your cell phone while driving, unless attached to a hands-free device.
- Drivers under 18 may not use a cell phone, pager, laptop, or any other electronic communication device to speak or text while driving, even if it is hands-free.
- The use of a handheld cell phone while driving is a primary offense, and you can be pulled over.
- The use of a hands-free device while driving is a secondary offense. A law enforcement officer may cite you for using a hands-free device if you are pulled over for another violation.
Both laws allow for the use of cell phones to make emergency calls to law enforcement agency, medical provider, the fire department, or other emergency services agency.
